Our Terms

1. Definitions

Client: The individual or entity booking the photography/videography services.

Photographer: The photographer/videographer providing the services.

Services: The photography and/or videography services provided as described in the contract.

2. Booking and Payment

Booking Fee: If opting for the one-time rate, a non-refundable booking fee of 50% of the total cost is required to secure the booking. This fee will be applied towards the total cost.

Payment Schedule: The remaining balance (minus the 50% deposit) is due before delivery of final images/work.

Other Payment Options: If opting for a monthly retainer, the first month is payable upfront with a minimum 3-month commitment (invoiced monthly). For block bookings of hours, full payment is required before work commences.

Late Payments: A 3-day grace period applies. After this period, a 10% late fee will be added to the remaining balance.

Methods of Payment: Cash or bank transfer.

3. Cancellations and Refunds

Client Cancellations: If the Client cancels within 24 hours of the shoot, the booking fee is non-refundable. Other payments may be refunded depending on the notice given.

Photographer Cancellations: A full refund will be provided, or an alternative date can be arranged.

4. Rescheduling

Rescheduling must be requested at least 3 days before the shoot date and is subject to availability.

5. Scope of Work

Services Provided: The Client will receive an online gallery of fully edited, high-resolution images and/or video (quantity dependent on shoot duration).

Client Approval & Revisions: The Client has 7 days to review proofs. One round of revisions is included. Additional revisions will be charged at £10 per image (photography) or £100 per revision (video).

Music Choice: Videos are edited around the music choice. Only royalty-free music is used. If you have a specific genre or example in mind, this must be clearly stated beforehand. Otherwise, music selection will be at the editor’s discretion.

Additional Services: Any additional services requested will incur extra charges agreed upon in advance.

6. Copyright and Usage Rights

Ownership: Velvet Pickle Limited retains full copyright of all images and video taken.

Client Usage: The Client is granted a non-exclusive, non-transferable licence to use the edited images/video for website and social media purposes, with unlimited use of the supplied content.

Photographer Usage: Velvet Pickle Limited may use the images/video for portfolio, marketing, and promotional purposes unless requested otherwise in writing.

7. Deliverables

Format: Images will be delivered in JPEG format. Video will be delivered in a minimum of 1080p or 4K.

Delivery Time: Photos will be delivered within 7 days of the shoot. Videos will be delivered within 14 days (this may vary depending on project scope).

Delivery Method: Files will be delivered via online gallery link or file-sharing service (such as WeTransfer).

8. Model Release

The Client agrees that images of individuals present at the shoot may be used for promotional purposes unless otherwise agreed in writing.

9. Limitation of Liability

Velvet Pickle Limited will take all reasonable steps to provide high-quality services. In the unlikely event of issues beyond reasonable control (including equipment failure or force majeure), liability is limited to the amount paid by the Client.

10. Client Responsibilities

The Client is responsible for securing permissions for all locations and subjects involved in the shoot and for providing accurate instructions and details.

11. Indemnification

The Client agrees to indemnify and hold harmless Velvet Pickle Limited from any claims, liabilities, damages, or expenses arising from the Client’s use of the images/video.

12. Confidentiality

Both parties agree to maintain confidentiality of any sensitive information disclosed during the course of the project.

13. Governing Law

These terms and conditions are governed by the laws of England and Wales.

14. Agreement

By booking services, the Client agrees to these terms and conditions.

Additional Clauses

Force Majeure: Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control.

Severability: If any provision is found invalid or unenforceable, the remaining provisions shall continue in full effect.

Travel Time, Mileage & Accommodation: Travel and/or accommodation costs must be covered by the Client before travel. Travel time is charged at the editing rate (£25 per hour). Mileage is charged at £0.45 per mile.

Client Conduct: Inappropriate behaviour may result in termination of services without refund.

Annual Rate Increase: All rates are subject to an approximate annual increase of 10%.

Paid Advertising Usage: If materials are used for paid advertising or marketing campaigns, additional usage rights and fees must be agreed in advance.

Raw/Unedited Files: RAW files are not supplied as standard. If pre-agreed, this will incur an additional day rate and is subject to viability. No guarantee is made regarding usability, and Velvet Pickle Limited reserves the right to decline this request.

Minimum Amendment Charge: Revisions outside the agreed number will incur a minimum charge equivalent to one hourly rate.

Kit Rental (If Applicable): Any required rental equipment will be discussed and agreed in advance and added to the invoice.
